Kaliflower Ltd. – Shipping & Handling Terms and Conditions

These Shipping & Handling Terms and Conditions (“Terms”) apply to all products purchased from Kaliflower Ltd. (“Company,” “we,” “us,” or “our”). By placing an order, you (“Customer,” “you”) agree to these Terms.

1. General Shipping Policy

We aim to process and ship all orders within 1-5 business days of order confirmation. Delivery timeframes provided at checkout are estimates only and are not guaranteed. Actual delivery dates depend on the shipping carrier, destination, and other third-party factors.

2. Our Responsibility vs. Customer’s Responsibility

2.1 What Kaliflower Ltd. IS Responsible For (Refund Eligible)

We will issue a refund or replacement only in the following cases caused by our internal error:

- Improper packaging – If a product (especially spices, powders, or loose goods) was not securely sealed or packaged according to our internal standards, causing:

- The product to leak, spill, or escape its container inside the shipping box.

- Contamination of other products in the same package.

- The container to arrive damaged due to insufficient protective material.

- Wrong item shipped – You received a different product than what you ordered.

- Incorrect quantity – The order was missing items due to our packing mistake.

- Clear product defect – The item was spoiled, expired, or otherwise unusable at the time of packing, and you notified us within [5] days of delivery with photographic evidence.

2.2 What Kaliflower Ltd. IS NOT Responsible For (No Refund)

We do not offer refunds, replacements, or credits for the following events, as they are outside our reasonable control:

- Shipping delays – Late delivery by USPS, FedEx, UPS, DHL, or any other carrier, including weather-related delays, customs holds, or peak-season backlogs.

- Lost or stolen packages – Once the carrier scans the package as “delivered,” risk of loss passes to you. We are not responsible for theft or misdelivery after that point. (Exception: we will assist as best we can with a missing package claim, but we do not guarantee a refund).

- Carrier mishandling – If the shipping box is crushed, dented, or damaged in transit, and the outer box shows signs of rough handling by the carrier, you must file a claim directly with the carrier. We will provide proof of proper original packaging upon request.

- Address errors – If you provide an incorrect, incomplete, or outdated shipping address, and the package is lost, returned, or delayed. Reshipment costs will be billed to you.

- Delivery refused by recipient – If you refuse delivery without prior arrangement, we will not refund the original shipping cost. Return shipping and restocking fees may apply.

- Temperature or environmental damage – Unless we explicitly sell a product as “temperature-controlled,” we are not responsible for heat, cold, or humidity affecting product quality after the package leaves our facility.

- Customer mishandling after delivery – We are not responsible for products that spoil, leak, or degrade due to how you store or handle them after delivery.

3. Specific Spill/Leak Policy (Spices & Powders)

Because Kaliflower Ltd. sells spices and other fine powders, we take extra precautions in packaging. However:

- If the spill occurred due to our error (e.g., lid not fully tightened, bag not fully sealed, missing inner seal, inadequate cushioning), we will refund the full purchase price of the affected product(s) plus proportional shipping, or send a replacement at no cost.

- If the spill occurred due to carrier mishandling (e.g., the shipping box is crushed, punctured, or shows signs of being dropped violently), we will not refund. We will, however, provide photos of how the item was packed and any supporting documentation to help you file a claim with the carrier.

- If the spill is minor (less than 10% of contents lost) and the product is still usable, no refund will be issued.

To request a refund for a spill/leak you believe is our fault:‍ ‍

Send clear photos within 48 hours of delivery to dmdivita@yogadivita.com showing:

1. The outer shipping box (all sides)

2. The inner packaging materials

3. The damaged product container and spilled contents

We will review the evidence. If we determine it was our packaging error, we will refund or replace. If we determine it was carrier mishandling or customer error, we will deny the refund.

4. Return & Refund Process for Qualifying Issues

If your issue falls under Section 2.1 (our responsibility):

1. Contact us at dmdivita@yogadivita.com within 10 days of delivery.

2. Provide your order number, photos/video of the issue, and a brief description.

3. We may request you return the product (at our expense) for quality control.

4. Approved refunds will be issued to your original payment method within 5-10 business days.

We do not offer refunds for:

- Change of mind

- Ordering the wrong product (unless we shipped the wrong item)

- “I don’t like the taste” or subjective quality claims

5. Shipping Charges

- Original shipping fees are non-refundable unless the error was entirely ours (e.g., we shipped the wrong item).

- If a refund is issued for a qualifying product issue, we will refund actual shipping costs paid, but not expedited shipping upgrades unless the upgrade caused no benefit due to our delay.

6. Limitation of Liability

To the maximum extent permitted by law, Kaliflower Ltd.’s total liability for any claim arising from shipping or handling shall not exceed the total amount you paid for the product(s) in that order. We are not liable for any indirect, incidental, or consequential damages (e.g., lost business, ruined meals, or emotional distress) resulting from shipping delays, carrier damage, spills, or packaging failures.

7. Dispute Resolution

Any dispute regarding shipping, handling, or refunds must be submitted in writing within 30 days of the delivery date. Failure to do so waives your right to a refund or credit.

8. Changes to These Terms

We may update these Terms at any time. Changes apply to orders placed after the update date.

By completing a purchase from Kaliflower Ltd., you acknowledge that you have read, understood, and agree to these Shipping & Handling Terms and Conditions.

Additional Terms for Yoni Steaming Tea Mixes & Skincare Products

1. Yoni Steaming Tea Mixes (Herbal Blends)

1.1 Product Integrity & Packaging

Our yoni steaming tea mixes contain dried, natural herbs. We package them in [heat-sealed / resealable / compostable] bags designed to preserve freshness. However, because these are botanical products:

- Minor herb dust or settling is normal and does not qualify for a refund.

- Clumping due to humidity during carrier transit is not our responsibility unless the outer packaging was visibly damaged or improperly sealed by us.

1.2 Refund Eligibility – Yoni Steaming Teas

We will refund or replace if:

- The inner bag was not properly sealed by us, causing herbs to spill into the shipping box.

- You received the wrong blend.

- The product arrived with visible mold or moisture damage, and the outer shipping box is intact (indicating the issue originated before leaving our facility).

We will NOT refund for:

- Carrier-related moisture exposure (e.g., package left in rain, delivered to a damp location).

- Slight fragrance variation – Herbs are natural; scent and color may vary by batch.

- Personal preference – You do not like the smell, texture, or steaming experience.

- Misuse – Using the tea for anything other than its intended external steaming application. (This product is not for ingestion. We are not liable for any adverse effects from improper use.)

1.3 Important Safety Disclaimer (Yoni Steaming)

Yoni steaming is a personal wellness practice. Kaliflower Ltd. does not make any medical claims regarding our steaming tea blends. You are solely responsible for:

- Ensuring you are not pregnant, menstruating heavily, or have any medical condition that contraindicates steaming.

- Testing water temperature to avoid burns.

- Consulting a healthcare provider before use.

We will not refund or accept returns on yoni steaming products that have been opened or used for safety and hygiene reasons, unless the defect was clearly present before opening (e.g., visible mold through the sealed bag).

2. Skincare Products (e.g., serums, balms, masks, oils)

2.1 Temperature & Transit Sensitivity

Some of our skincare products (e.g., natural butters, oil-based serums, balms) are sensitive to extreme temperatures. While we take care to package items securely:

- Melting or softening during hot weather transit is not our responsibility unless the product was packaged without adequate internal protection (e.g., missing material when required).

- Separation of natural ingredients (oils and butters separating due to temperature changes) is common and does not indicate spoilage. If separation occurs, simply stir or gently warm the product to re-emulsify (where applicable). No refund will be issued for natural separation alone.

2.2 Refund Eligibility – Skincare Products

We will refund or replace if:

- The container was damaged due to our poor packaging (e.g., loose lid, insufficient padding, wrong box size).

- The product leaked out of its container because we failed to secure the seal or cap properly.

- You received an expired or clearly contaminated product (e.g., mold, foul odor not characteristic of the ingredients) upon opening, provided you contact us within [48–72 hours] of delivery with photos.

We will NOT refund for:

- Carrier mishandling that cracks the container or causes leakage (file a claim with the carrier; we will assist with documentation).

- Melting, softening, or hardening due to weather during transit.

- Allergic reactions or skin irritation – Skincare ingredients affect individuals differently. You are responsible for patch testing before full use. We list all ingredients on each product page. No refund will be issued for sensitivity, rash, or allergic response.

- Normal product color/texture variation – Natural, preservative-free skincare may vary slightly by batch.

- Product used more than 25% – We cannot refund partially used skincare products unless the defect was present from the start.

2.3 Hygiene & Return Restrictions

For health and safety reasons, we do not accept returns or offer refunds on any skincare product that has been opened and used, unless the product arrived defective (e.g., mold, foreign object, wrong item). This includes:

- Balms, creams, serums, oils, masks, and scrubs.

- Any product where the safety seal was broken by the customer.

If you believe a defective product was shipped, do not use it further. Contact us immediately with photos of the unaltered product and packaging.

3. How to File a Claim for Yoni Tea or Skincare Products

To request a refund or replacement for issues covered under our responsibility (improper packaging, wrong item, defect before use):

1. Contact dmdivita@yogadivita.com within 10 days of delivery.

2. Provide your order number and clear, well-lit photos showing:

- The outer shipping box (all sides)

- The product’s original packaging

- The defect (spill, improper seal, mold, leakage, etc.)

3. For skincare: include the batch number if visible on the label.

We will review your claim within [3–5 business days]. If approved, we will issue a refund or ship a replacement at no cost. If denied, we will explain why (e.g., evidence points to carrier damage or customer misuse).

4. Final Note on “Natural” Products

Kaliflower Ltd. takes pride in offering handmade, natural, and preservative-free products wherever possible. Because of this:

- Some variation in color, scent, texture, and consistency is normal and expected.

- These variations do not qualify for a refund unless they indicate spoilage (e.g., rancid smell, visible mold, fermentation).
